1. Definitions

"Company" refers to Puercoespin Safaris. "Client" or "You" refers to the person making the booking. "Tour" refers to any safari package or service booked through our company.

2. Booking and Confirmation

All bookings are subject to availability. A booking is confirmed only when:

  • The completed booking form has been received
  • The required deposit (30% of total cost) has been paid
  • A confirmation email has been sent to the client

The company reserves the right to decline any booking at its discretion.

3. Payment Terms

Deposit

A non-refundable deposit of 30% of the total tour cost is required to confirm your booking.

Balance Payment

The remaining balance must be paid no later than 30 days before the tour start date. If the balance is not received by this date, the company reserves the right to treat the booking as cancelled.

Last-Minute Bookings

For bookings made within 30 days of departure, full payment is required at the time of booking.

Payment Methods

We accept credit/debit cards (Visa, Mastercard), bank transfers, and M-Pesa. All payments are processed in USD unless otherwise agreed.

4. Cancellation and Refund Policy

By the Client

Cancellation charges are calculated from the date we receive written notification:

  • 30+ days before departure: Full refund minus deposit
  • 15-29 days before departure: 50% refund of total tour cost
  • 14 days or less: No refund

By the Company

The company reserves the right to cancel any tour due to circumstances beyond our control (force majeure). In such cases, clients will receive a full refund or alternative arrangements.

5. Tour Prices

All prices are quoted in US Dollars (USD) unless otherwise stated. Prices include only those items specifically listed in the tour itinerary. The company reserves the right to adjust prices due to:

  • Changes in government taxes or park fees
  • Currency fluctuations
  • Fuel surcharges imposed by transport providers

6. Changes to Itinerary

The company reserves the right to alter itineraries due to weather conditions, road closures, security situations, or other circumstances beyond our control. Any significant changes will be communicated to the client as soon as possible.

7. Travel Insurance

Travel insurance is mandatory for all clients. Insurance must cover medical emergencies, trip cancellation, personal liability, and emergency evacuation. The company is not responsible for any costs arising from inadequate insurance coverage.

8. Passports and Visas

Clients are responsible for ensuring they have valid passports (minimum 6 months validity) and appropriate visas for Kenya and any other countries included in the itinerary. The company can provide visa guidance but is not responsible for visa rejections.

9. Health and Medical

Clients must inform the company of any medical conditions, disabilities, or dietary requirements at the time of booking. The company reserves the right to decline a booking if a client's medical condition may pose a risk to themselves or others during the tour.

10. Liability

The company acts as an agent for various suppliers (hotels, transport companies, etc.). While we exercise care in selecting our partners, we are not liable for:

  • Injury, illness, death, loss, or damage arising from the acts of third-party suppliers
  • Delays, cancellations, or changes caused by circumstances beyond our control
  • Loss or damage to personal property during the tour

11. Client Responsibilities

Clients are expected to:

  • Behave in a manner appropriate to group travel
  • Follow the instructions of tour guides and park authorities
  • Respect local customs, cultures, and wildlife
  • Not engage in illegal activities

The company reserves the right to remove any client from a tour if their behavior is disruptive or dangerous, without refund.

12. Complaints

Any complaints should be reported immediately to the tour guide or company representative. If the issue cannot be resolved during the tour, written complaints should be submitted within 14 days of tour completion.

13. Governing Law

These terms and conditions are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
